This Acceptable Use & Compliance Policy (the “AUP”) is incorporated into, and forms a binding part of, the Self Serve Leads Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service. Violation of this AUP is a material breach of the Terms and may result in immediate suspension or termination without refund, in addition to all other legal and equitable remedies available to Company.
1. The One Permitted Use
Phone numbers in the Licensed Data are formatted to the Meta Custom Audience upload specification (country code, digits only, no symbols) so they may be hashed and uploaded to maximize match rate. The presence of a phone number, email address, or postal address in the Licensed Data is not an authorization, consent, or invitation to contact that individual by phone, SMS, fax, email, or postal mail.
2. Strictly Prohibited Uses
Customer shall not, and shall not permit any third party to, use the Licensed Data:
- For outbound telemarketing, cold calling, robocalls, ringless voicemail, predictive dialing, or any live or pre-recorded telephone solicitation;
- For SMS, MMS, RCS, or any other text-message campaign, whether marketing, informational, or transactional;
- For facsimile (fax) transmissions of any kind;
- For email marketing, cold outreach, drip sequences, newsletters, or any unsolicited commercial email (UCE);
- For physical direct mail, unless Customer independently and lawfully obtains a separate legal basis to mail the recipient;
- For any purpose regulated by the Fair Credit Reporting Act, including credit, insurance, employment, tenant, or volunteer screening, or for any decision producing legal or similarly significant effects;
- To identify, profile, target, surveil, harass, defame, dox, stalk, or discriminate against any individual, or to facilitate any unlawful discrimination based on a protected characteristic;
- To promote or facilitate any unlawful, deceptive, fraudulent, or misleading product, service, scheme, or representation, including illegal lotteries, pyramid schemes, deceptive “work-from-home” claims, fake invoices, or impersonation;
- To promote firearms, ammunition, explosives, tobacco, vapor products, recreational cannabis, controlled substances, prescription pharmaceuticals, adult content, gambling, multi-level marketing, debt-relief, payday/short-term lending, cryptocurrency token offerings, get-rich-quick programs, or any other category restricted by the advertising platform on which the Licensed Data will be uploaded, except in strict compliance with that platform’s rules and applicable law;
- To train, fine-tune, evaluate, or otherwise input into any artificial-intelligence or machine-learning model, foundation model, embedding, vector store, or dataset for resale;
- To resell, sublicense, broker, syndicate, lease, lend, give, or otherwise transfer the Licensed Data, in whole or in part, to any third party;
- To attempt to re-identify, de-anonymize, reverse engineer, or augment any hashed identifier;
- To circumvent any technical limitation, suppression list, opt-out, or tracer/seed record.
3. Customer Is Solely Responsible for Use
Customer is the sole controller of, and bears 100% legal and financial responsibility for, every use, communication, transmission, advertisement, or contact made with, derived from, or informed by the Licensed Data after delivery. This responsibility is absolute and includes, without limitation, compliance with the Telephone Consumer Protection Act, the Telemarketing Sales Rule, the CAN-SPAM Act, the Fair Credit Reporting Act, the Junk Fax Prevention Act, all state telemarketing, do-not-call, and SMS statutes, the General Data Protection Regulation, the UK GDPR, PIPEDA, CASL, and every advertising platform’s terms, community standards, and advertising policies. Company has no ability to, and does not, monitor, audit, control, approve, or assume responsibility for Customer’s campaigns, creative, targeting choices, or downstream use.
If Customer engages in any prohibited use, that use is unauthorized, is in violation of the Terms of Service and this AUP, and is solely Customer’s liability. Customer’s indemnification obligation under Section 7 of the Terms of Service covers all such uses in full.
4. Advertising-Platform Compliance
Before uploading any Licensed Data to any advertising platform, Customer shall:
- Read and comply with that platform’s current Custom Audience Terms (e.g., Meta’s Custom Audience Terms), Advertising Policies, and Community Standards;
- Provide and maintain any required end-user notices and opt-out mechanisms on its own properties;
- Use only the hashing, formatting, and upload tooling required by the platform;
- Honor any suppression, opt-out, deletion, or “do not contact / do not target” request received from a data subject within the time required by law and by the platform; and
- Maintain records sufficient to demonstrate compliance with the foregoing for a minimum of four (4) years.
5. Suppression and Opt-Out Honoring
Customer shall scrub each upload against its own internal suppression list and any do-not-contact lists applicable to the channel of use. Company maintains a master suppression list for individuals who have submitted opt-out requests to Company under our Privacy Policy and removes such records from Licensed Data going forward; however, Customer is responsible for re-checking any previously delivered Licensed Data against Customer’s own suppression list before each campaign.
6. Enforcement
Company may, at its sole discretion, investigate suspected violations of this AUP, suspend or terminate access without prior notice, reverse or recall deliveries, retain all fees paid, refer matters to law enforcement or regulators, and seek injunctive and monetary relief, including liquidated damages where set forth in an order form. Tracer and seed records are embedded in Licensed Data and may be used as evidence of violation.
7. No Legal Advice
Nothing in this AUP constitutes legal advice. Customer is solely responsible for obtaining its own legal counsel regarding the lawfulness of its campaigns, creative, and use of the Licensed Data in its particular jurisdiction.
